Program Description:  The Pharmacy Benefit Card program provided by OptumRx is a prescription drug program that provides a discount on FDA-approved drugs that are not covered by an insurance plan or Medicare prescription drug (Medicare Part D) plan. This is not insurance. The Pharmacy Benefit Card program is administered by OptumRx Discount Card Services, LLC. OptumRx pays a royalty fee to its partner brands such as AARP for use of their intellectual property. This text messaging program enabled on 58418 enables OptumRx to:

1) send digital pharmacy benefit cards to members,
2) send informational text or video messages to members,
3) send relevant pharmacy or product promotions to members,
4) send service messages such as reminders, updates to members.

Program Sponsor: The Pharmacy Benefit messaging service on 58418 (the “Program”) is enabled by OptumRx Discount Card Services, LLC (“We,” “Us,” “Our”, “OptumRx”).

User Opt In: The Program allows users to receive SMS/MMS mobile messages from 58418 by affirmatively opting into the Program or requesting information from the Program. Regardless of the opt-in method you utilized to join the Program, you agree that these Terms apply to your participation in the Program. This mobile messaging service requires human intervention for the mobile messages to be sent, and thus the mobile messages are not sent to you by an automatic telephone dialing system. We may deliver messages in the future, including marketing messages, using an automatic telephone dialing system based on your consent; and you understand that you are not required to agree to opt in as a condition of any purchase of goods or services. By texting an opt-in keyword related to this Program or replying affirmatively to a message from this Program requesting your consent to receive recurring messages, you are agreeing to these Terms and are agreeing to receive recurring text messages. By typing your phone number into a web form which includes a request for your affirmative consent to receive a text message from this Program, you are agreeing to these Terms. By sending a text message to this Program whether or not this Program responds to your message, you are also agreeing to these Terms. You must be 18 or older or have permission from a parent or guardian to participate.

Cost and Frequency: There is no additional fees or premium charges to receive text messages, however your standard carrier message and data rates may apply. The Program involves one time messages as well as recurring messages. The frequency of recurring text messages may vary based on your interactions with the Program Sponsor and this Program.

Opt Out: To opt out of receiving text messages from this Program, text or reply “STOP” to 58418. You will receive an additional mobile message confirming your decision to opt out of this Program. Your opt-out from this Program on this short code will not unsubscribe you from other programs you may have consented to receive text messages from. If you send a text message to this short code in the future or provide your consent to receive messages on this short code you will receive additional messages for this Program. At all times you must clearly communicate your intent to unsubscribe from the Program by utilizing opt-out commands. Additional supported opt-out commands can be sent include “QUIT”, “END”, “CANCEL”, “UNSUBSCRIBE”, or “STOP ALL” .

No Warranty: We will not be liable for any delays or failures in the receipt of any mobile messages. Delivery or timeliness of mobile messages is not guaranteed and subject to the sender or recipients service, connectivity, mobile device, and wireless service provider/network. T-Mobile is not liable for delayed or undelivered mobile messages. SMS and MMS messaging content may not be compatible with all phone models or carriers. Participating carriers include but are not limited to Verizon Wireless, T-Mobile, MetroPCS, AT&T, Sprint, and U.S. Cellular.

Miscellaneous: You warrant and represent that you have all necessary rights, power, and authority to agree to these Terms and perform your obligations hereunder, and nothing contained in this Agreement or in the performance of such obligations will place you in breach of any other contract or obligation. The failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further rights hereunder. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect and enforceable. We reserves the right to change these Terms from time to time and you acknowledge your responsibility to review these Terms from time to time to be aware of any such changes. Your continued participation in the service after any such change shall constitute your acceptance of the modified Terms. If you do not agree to a change in these Terms, you must immediately opt-out using the commands listed above.
